Terms of Use

The ground rules: what Boki provides, what you agree to by using it, what remains yours, and what happens if things go wrong.

1. Purpose

These terms govern access to and use of the Boki mobile app and the getboki.app website, published by [company name, registered office, RCS, contact email], hereinafter "Boki".

2. Acceptance

Creating an account constitutes acceptance of these terms and of the privacy policy. If you do not accept these terms, do not use the service.

3. Description of the service

Boki is a photography learning service: short lessons, shooting exercises, automated analysis of your images, skill-based progression and a community space.

The analysis of your photos is produced by automated processing. It is an indicative learning aid, not an aesthetic judgment or a technical appraisal. Boki does not guarantee any particular skill level will be achieved.

4. Account and eligibility

The service is reserved for people aged 15 or over; below that age, signing up requires the consent of a person with parental authority. You agree to provide accurate information, to keep your login credentials confidential, and to notify us of any unauthorized use of your account. An account is personal and may not be transferred or shared.

5. Subscription and payment

Boki offers limited free access and a paid subscription that unlocks all learning paths. [to be completed: plans, prices including VAT, commitment period, trial period]

Subscriptions purchased in the app are billed through the App Store and renew automatically unless canceled at least 24 hours before the end of the current period. You can manage and cancel them in your Apple account settings; refund requests are subject to Apple's terms.

6. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, you have 14 days to withdraw. By requesting immediate access to digital content, you acknowledge that performance begins before the end of this period and waive your right of withdrawal for the portion already performed, under the conditions of Article L221-28.

7. Your content

You retain the rights to the photos and text you publish. You grant us a non-exclusive, royalty-free license, limited to operating the service, to host, reproduce, analyze and display your content in the app, and to show it to other users if you choose to publish it. This license ends when you delete the content, subject to backup copies and legal retention obligations.

Any use of your photos for promotional purposes will require a separate request for permission. You warrant that you hold the rights to the content you publish and have obtained the consent of any identifiable people in your images.

8. Community guidelines

The following are prohibited on Boki:

  • unlawful, hateful, violent or pornographic content, or content that undermines human dignity;
  • content depicting minors in an inappropriate manner;
  • publishing images you did not create or for which you do not hold the rights;
  • harassment, impersonation, spam and commercial solicitation;
  • the use of bots, automated content scraping, and any attempt to circumvent the service's limitations.

Any user can report content from within the app. We review reports and may remove content, or restrict or close an account. You will be informed of the decision and may challenge it by writing to hello@getboki.app.

9. Boki's intellectual property

The app, its code, its interface, its educational content, the Boki mascot, trademarks and logos are protected and remain the exclusive property of the publisher. Your subscription grants you a personal, non-transferable right of use, excluding any reproduction, distribution or resale of lesson content.

10. Service availability

We strive to provide continuous access, without any guarantee of permanent availability. The service may be interrupted for maintenance, updates or in cases of force majeure. We may change features and add or remove learning paths; the removal of a substantial feature of a paid subscription will be announced in advance.

11. Liability

Boki is liable for direct damages resulting from a breach of its obligations, to the extent permitted by law. We cannot be held liable for damages related to the loss of content of which you did not keep a copy, to the use of your photography equipment, or to situations you put yourself in to complete an exercise.

You alone are responsible for your safety while taking photos. Never take risks to complete an exercise.

The statutory warranties of conformity and against hidden defects apply as of right to consumers.

12. Termination

You can delete your account at any time from Profile → Settings → My data. Deletion results in the loss of your progress and photos after the period stated in the privacy policy, and does not entitle you to a refund for the current period.

We may suspend or close an account in the event of a serious breach of these terms, after a formal notice that has gone unheeded, except in cases of urgency or manifest unlawfulness.

13. Changes to the terms

These terms may be amended. Any substantial change will be notified in the app or by email at least 15 days before it takes effect. If you do not accept the new terms, you may cancel your subscription free of charge until that date.

14. Governing law and disputes

These terms are governed by French law. In the event of a dispute, please first send us a complaint at hello@getboki.app. If no solution is found within two months, you may use a consumer mediator (médiateur de la consommation) free of charge: [name and contact details of the mediator to be appointed], or use the European Online Dispute Resolution platform. Failing agreement, the French courts have jurisdiction.
